RAK COURTS

RAK Courts Department is considered a judicial monument in UAE, which came a long way in achieving justice and legal protection for the various segments of the emirate’s society from investors, workers and individuals. 

The RAK Courts Department has become a symbol of justice and legal protection for various segments of society in the UAE. Its mission to provide a legislative framework and modern governance systems that keep up with environmental, technical, and scientific changes has led to high levels of satisfaction among its stakeholders.

The department has successfully reduced the average duration of civil cases and empowered judges to enhance their performance and independence. It has also improved the quality of experts’ reports and activated the family case-solving process through guidance, awareness, and friendly settlement. These efforts have resulted in numerous outstanding achievements, including judicial judgments based on the latest scientific grounds, legal rules, electronic judicial services, and the completion of the institutional structure of the Supreme Courts in Ras Al Khaimah.

In cooperation with the EGA, RAK Courts Department has launched a range of services, including the E-registration of civil lawsuits. This enables advocates, representatives, and legal units in banks and debt collection companies to register civil lawsuits electronically from their headquarters, without the need to visit printers’ offices. Additionally, RAK Courts Department plans to offer an auction service through smartphones and a family counseling service.

The objective of the RAK Courts Department is to ensure justice and safeguard the rights and liberties of individuals in the community by implementing the Sharia laws currently enforced in the emirate.

First Instance Court

The initial stage of legal proceedings, where litigants can seek to assert their rights or obtain any court-related services, regardless of the nature or value of the claim or service. The Court is structured into partial and plenary circuits, based on the value of the claim in civil lawsuits, and the severity of the crime in criminal lawsuits, in order to ensure efficient and effective delivery of justice to customers.

Appeal Court

The second level of litigation to which litigants may resort if they find the First-Instance judgment rendered in any civil, criminal or personal status articles to be inadmissible. Unless excluded by law, litigants have the right to appeal before the Appeal Court to amend or cancel the First-Instance judgment

Family Court

The Family Court is a separate entity from the Courts Department that handles all legal matters related to family disputes, including personal status lawsuits. The court offers guidance and reform services, facilitates agreements between spouses, and has jurisdiction over settlements related to alimony, custody, and visitation.

Labor Court

The Labor Court, located in TAWAFOQ Center, has exclusive jurisdiction over all labor-related lawsuits, including disputes between laborers and their sponsors arising from individual labor contracts sponsored by the competent authority under Federal Law No. 8 of 1980.

Financial Court

The Financial Court has jurisdiction over financial, commercial, and civil lawsuits with a claim of at least AED 1,000,000/-, and judgments rendered by the court are not appealable, but reconsideration appeals may be submitted. The court registers claim in a digital registration system and may conduct judicial mediation between parties, and if conciliation is reached, it has the power of a writ of execution.

One-Day Court

The One-Day Court, established in 2017 under the Ras Al Khaimah Courts Department, has jurisdiction over civil and commercial lawsuits with a claim value of up to AED 500,000. Lawsuits are registered directly and proceedings are conducted electronically, with judgments rendered on the same day of registration. The court’s execution judge is responsible for enforcing its judgments.

One-Session Court

The One-Session Court in RAK was established in 2017 with the jurisdiction to consider civil and commercial cases with a claim value not exceeding AED 500,000. The court issues its judgment in the first session and litigants can appeal its judgments before the competent Court of Appeal, except in cases that are exempted by law.
